Terms of Use

These Terms of Use ("Terms") govern your use of Cognical, a product built and operated by Dynamed Solutions, LLC ("Dynamed", "we", "us", "our"). By using Cognical, you agree to these Terms. If you do not agree, do not use the product.

1. Eligibility

You must be at least 18 years old to use Cognical. By using the product, you represent that you meet this requirement.

2. The service

Cognical is a tool for understanding and working with how your cognitive system handles everyday friction. It consists of an assessment that produces a cognitive dynamics profile, and three modes (nudge, check, think) that draw on that profile to provide responses to situations you bring to the product.

Cognical's framework is grounded in established cognitive and behavioral science but is not itself a clinical instrument. The dynamics profile is our internal model of how your system tends to operate. It is not a diagnostic result.

3. Not medical advice or treatment

Cognical is not medical advice, mental health treatment, therapy, or a substitute for professional care. The product does not diagnose any condition, does not prescribe any treatment, and is not designed for use in clinical settings.

If you are experiencing a mental health crisis, suicidal thoughts, or any situation requiring professional intervention, contact a licensed mental health professional, your physician, or an emergency service. Do not rely on Cognical for help in crisis situations.

Nothing in Cognical replaces the judgment of a licensed professional.

4. Account and access

To save a profile across sessions, you may provide an email address. We use that email to authenticate you on return visits. We do not require any other personal information.

You are responsible for maintaining the confidentiality of access to your email account, and for any activity that occurs under your Cognical profile.

5. Acceptable use

You agree not to:

• Use Cognical for any purpose that violates law or the rights of others
• Attempt to access accounts, profiles, or data that are not yours
• Probe, scan, or test the vulnerability of the service, or breach security or authentication measures
• Use automated means (scrapers, bots) to access the service except as we expressly permit
• Reverse engineer, decompile, or attempt to extract the source code of the product
• Use the product in any manner that could disable, overburden, or impair its operation
• Use Cognical to harm yourself or others, including by treating it as a substitute for professional care in situations that require it

We use automated content moderation to identify requests that appear to involve harmful intent, illegal activity, or content outside what the product is designed to handle. We may decline to respond to such requests.

6. Intellectual property

The Cognical name, logo, framework, assessment, modes, and underlying software are owned by Dynamed Solutions, LLC. We grant you a personal, non-exclusive, non-transferable, revocable license to use the product for its intended purpose. We do not grant you any rights to copy, modify, redistribute, or create derivative works.

7. Disclaimers

Cognical is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the product will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.

You use Cognical at your own discretion and risk. You are responsible for any decisions you make based on its output.

8. Limitation of liability

To the fullest extent permitted by law, Dynamed Solutions, LLC and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising out of or related to your use of Cognical, regardless of the legal theory.

Our total liability to you for any claim arising out of or related to these Terms or the product will not exceed the total fees you paid us in the twelve (12) months preceding the event giving rise to the claim. If you have not paid us any fees in that period, our total liability will not exceed one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the limitation of certain damages. In those jurisdictions, the limitations above apply to the maximum extent permitted by law.

9. Account termination and data deletion

You may stop using Cognical at any time.

If you wish to delete your account and associated data (your email and dynamics profile), email [email protected] from the address associated with your account. We will process verified deletion requests within thirty (30) days.

We may suspend or terminate your access to Cognical at any time, with or without notice, if we believe you have violated these Terms or used the product in a way that creates risk for us or other users.

10. Governing law and dispute resolution

These Terms are governed by the laws of the State of Maryland, without regard to conflict of laws principles.

Any dispute arising out of or related to these Terms or your use of Cognical will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Maryland or by remote means agreed by the parties. You and Dynamed Solutions, LLC each waive the right to a jury trial and the right to participate in a class action against the other. Either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of the document. If a change is material, we will make reasonable efforts to notify you, including by email if you have provided one. Your continued use of Cognical after a change constitutes acceptance of the updated Terms.
